Terms of Service — OVRLab

These Terms of Service (“Terms”) govern your access to and use of the OVRLab website and applications, including any related features, content, and services (collectively, the “Services”).

The Services are provided by Jubba Cyber Services B.V., doing business as OVRLab (“OVRLab,” “we,” “us”).

By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

1) The Services

OVRLab provides software that enables peer‑to‑peer networking and end‑to‑end encrypted messaging. The Services may include:

authentication via Google Sign‑In,

generation and use of cryptographic keys,

peer discovery and peer‑to‑peer communication (including via WebRTC),

delivery of encrypted messages between users/devices.

You understand and agree that the Services are network‑dependent and require internet connectivity.

2) Eligibility

You may use the Services only if you can legally form a binding contract with OVRLab under the laws applicable to you. If you are using the Services on behalf of an organization, you represent and warrant that you have authority to bind that organization to these Terms.

The Services are intended for a general audience and are not specifically directed to children.

3) Accounts and Google Sign‑In
3.1 Authentication

The Services use Google Sign‑In for authentication. You are responsible for maintaining the security of your Google account and for all activity that occurs through your use of the Services.

3.2 Google Drive App Data storage

The Services use Google Drive App Data storage (drive.appdata) to store your cryptographic keys in your Google account. You acknowledge:

this storage is controlled by your Google account permissions,

if you revoke Google access, delete App Data, or lose access to your Google account, you may lose access to your keys and related functionality.

4) Peer‑to‑peer networking and device resources
4.1 Peer connections

The Services may establish direct peer‑to‑peer connections between your device and other users’ devices. As a result:

your device may exchange technical connection information with peers (including IP address and public keys),

you may connect to peers that are operated by independent third parties.

4.2 Device and network usage

By using the Services, you agree that the Services may use some of your device resources, such as:

network bandwidth,

CPU/memory,

local storage (for app operation and message storage on your device).

Your mobile carrier or internet provider may charge you for data usage. You are responsible for any such charges.

4.3 Connectivity infrastructure (STUN)

To facilitate WebRTC connectivity, the Services may use STUN servers provided by Cloudflare. You acknowledge that establishing peer connections may involve interactions with third‑party networking infrastructure.

5) End‑to‑end encryption and delivery expectations
5.1 End‑to‑end encryption

The Services are designed so that message content is end‑to‑end encrypted between sender and intended recipient(s). OVRLab does not have access to message contents under normal operation.

5.2 No OVRLab server storage of message content

OVRLab does not store message contents on OVRLab‑controlled servers. Messages may be stored locally on your device and on recipients’ devices/accounts.

5.3 No guarantee of delivery

Peer‑to‑peer systems can be affected by network conditions, device availability, and peer connectivity. You acknowledge and agree that OVRLab does not guarantee:

that messages will be delivered,

that delivery will be timely,

that the Services will be uninterrupted or error‑free.

You should not rely on the Services for time‑critical or emergency communications.

6) Acceptable use

You agree not to use the Services to:

violate any law or regulation,

send spam, phishing, scams, or other abusive communications,

distribute malware or attempt unauthorized access to any system,

harass, threaten, or violate the rights of others,

interfere with or disrupt the Services or any peer/network (including attempts to overload or degrade the network),

attempt to bypass security or cryptographic protections.

We may suspend or terminate your access to the Services if we reasonably believe you violated these Terms or pose a security or abuse risk.

7) Your content and communications
7.1 Your responsibility

You are responsible for the content you send or make available through the Services (“User Content”), including ensuring you have the rights to send it.

7.2 Limited license to provide the Services

You grant OVRLab a limited, non‑exclusive license to process, transmit, and display User Content solely as necessary to operate and provide the Services (for example, to deliver encrypted messages to intended recipients and facilitate peer‑to‑peer networking).

Because message content is end‑to‑end encrypted and not stored on OVRLab servers, OVRLab generally cannot view or moderate message contents.

8) Privacy

Our Privacy Policy describes how we collect, use, and share information. By using the Services, you agree to the Privacy Policy.

9) Third‑party services and stores

The Services rely on or interact with third‑party services (such as Google, Cloudflare, and Sentry). Your use of third‑party services may be governed by their own terms and policies. OVRLab is not responsible for third‑party services.

If you download the App from a third‑party store (such as Apple App Store, Google Play, or Chrome Web Store), your use may also be subject to that store’s terms and policies.

10) Intellectual property

OVRLab and its licensors own all rights, title, and interest in and to the Services, including software, documentation, branding, and design, except for User Content and any third‑party components.

The Services may include open‑source software components. Those components are governed by their applicable open‑source licenses.

11) Feedback

If you provide suggestions, ideas, or feedback to OVRLab (“Feedback”), you grant OVRLab the right to use the Feedback without restriction and without compensation.

12) Suspension and termination

You may stop using the Services at any time.

We may suspend or terminate your access to the Services:

to enforce these Terms,

to address security or abuse risks,

if required by law, or

if we discontinue the Services (in whole or in part).

Sections that by their nature should survive termination will survive (including Sections 5, 10, 13, 14, and 15).

13) Disclaimers

To the maximum extent permitted by law, the Services are provided “AS IS” and “AS AVAILABLE.”

OVRLab disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non‑infringement.

OVRLab does not warrant that:

the Services will be uninterrupted, secure, or error‑free,

message delivery will occur or occur within any time,

the Services will meet your requirements.

Nothing in these Terms limits any mandatory consumer rights that cannot be waived under applicable law.

14) Limitation of liability

To the maximum extent permitted by law:

OVRLab will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, goodwill, or business interruption, arising out of or related to your use of the Services.

OVRLab’s total liability for any claim arising out of or relating to the Services will not exceed EUR 100.

Some jurisdictions do not allow certain limitations of liability, so these limits may not apply to you to the extent prohibited by law.

15) Indemnification

To the maximum extent permitted by law, you agree to indemnify and hold harmless OVRLab from and against claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to:

your use of the Services,

your User Content, or

your violation of these Terms or applicable law.

16) Changes to the Services or these Terms

We may modify, suspend, or discontinue the Services (in whole or in part) at any time.

We may update these Terms from time to time. If we make material changes, we will post updated Terms and update the “Last updated” date. Your continued use of the Services after changes become effective means you accept the updated Terms.

17) Governing law and jurisdiction

These Terms are governed by the laws of the Netherlands, without regard to conflict‑of‑laws rules.

You agree that disputes arising out of or relating to these Terms or the Services will be subject to the jurisdiction of the competent courts in the Netherlands, unless applicable law requires otherwise.

18) Miscellaneous

Severability: If any provision is held invalid or unenforceable, the remaining provisions will remain in effect.

No waiver: Failure to enforce any provision is not a waiver.

Assignment: You may not assign these Terms without our consent. We may assign these Terms as part of a merger, acquisition, or sale of assets.
